All notices, consents, approvals and waivers made or given in connection with this Policy must be in writing to be effective. Parties shall provide effective notice (“Notice”) to each other, including any request to cancel service agreement, via the following method of delivery effective at the date and time which the Notice is sent:

CLIENT DESIRES TO CANCEL 

If the Service Dates of the Agreement have not yet begun and the Client requests to cancel the Agreement, the Client agrees to give a 30-day Notice for Travel Nanny Services / Short Term Nanny Services and a 7-day notice for Special Events Nanny Services/ Occasional Use Nanny Services/ Lifeguard Services to cancel the Service Agreement as to allow the Provider an opportunity to re-book the Service Dates. Any retainer collected will not be refunded and the Client agrees that the retainer fee fairly compensates the Provider for committing to provide the Services, Service Dates of the Agreement and turning down other potential projects/ clients. 

If the 30-day Notice to cancel services for Travel Nanny Services/ Short Term Nanny Services or 7-day notice for Special Events Nanny Services/ Occasional Use Nanny Services/ Lifeguard Services is not provided in written communication to the Provider as outlined in the agreement, liquidated damages shall be charged in the reasonable amount of the Anticipated Agreement value, to be offset by Nonrefundable Retainer. Provider reserves the right to decline rescheduling services and/or future bookings. 

If services have begun and the agreement is canceled prior to the end date as stated in the agreement service dates for any reason (including style differences or change in needs) other than gross negligence of child, endangerment and abuse, stealing or breach of confidentiality provision of this agreement, any retainer collected will not be refunded and liquidated damages shall be charged in the reasonable amount of the full Anticipated Agreement value, to be offset by Nonrefundable Retainer.  The Provider will receive paid transportation to the Provider's original home location if on a travel opportunity with the Client. 

The Provider will not be obligated to refund any portion of monies Client has previously paid to Provider. 

Provider reserves the right to decline rescheduling services and/or future bookings.

Client can immediately cancel the agreement if the Provider is suspected and determined by Law Enforcement to be gross negligent to the child or family members, endangerment of safety and abuse, stealing or breach of confidentiality provision of this agreement. The Provider will receive payment for all services previously rendered and the non-refundable retainer will be applied to the balance for services previously rendered.  The Provider will not be obligated to refund any portion of monies Client has previously paid to Provider. The Provider reserves the right to refund or decline a refund for any retainers collected in good faith as the Client agreed that the retainer fee fairly compensates the Provider for committing to provide the Services, Service Dates of the Agreement and turning down other potential projects/ clients.  The Client will be relieved of any future payment obligations. The Provider will receive paid transportation to the Provider's original home location if on a travel opportunity with the Client.

 

PROVIDER DESIRES TO CANCEL 

The Provider is expected under the agreement to fulfill service dates as outlined. However, under rare and unusual circumstances such as an emergency or unsatisfactory work environments, If the Provider desires to cancel Services of Client for reasons (including style differences) other than gross negligence to Provider, endangerment and abuse, the Provider shall provide at least 14-day Notice to the Client to cancel the agreement. The Provider will receive payment for all services previously rendered and the non-refundable retainer will be applied to the 14-day notice to cancel agreement period. The Provider will not be obligated to refund any portion of monies Client has previously paid to Provider. If the client declines to continue services during the 14-day notice to cancel agreement, any retainer collected will not be refunded.  At the Client's discretion, the Provider can either attempt to find a reasonable substitute to fulfill the terms of the Agreement with no guarantee of success or the Provider shall excuse the Client of further payment obligations after the 14-day Notice to cancel Agreement is fulfilled. The 14-day notice to cancel agreement period begins at the date and time which the Notice is sent via email to the Client. Provider will receive paid transportation to the Provider's original home location if on a travel opportunity with the Client.

 

In the event Provider is physically or mentally unable to perform obligations in any or all parts of the Agreement, the Provider (or a responsible party) will immediately give Notice to the Client. The Provider will receive payment for all services previously rendered. At the Client's discretion, the Provider can either attempt to find a reasonable substitute to fulfill the terms of this Agreement with no guarantee of success or the Provider shall excuse Client of further payment obligations in this Agreement. The Provider reserves the right to refund or decline a refund for any retainers collected in good faith as the Client agreed that the retainer fee fairly compensates the Provider for committing to provide the Services, Service Dates of the Agreement and turning down other potential projects/ clients.  The Provider will receive paid transportation to the Provider's original home location if on a travel opportunity with the Client.

 

If the Provider desires to cancel Services for gross negligence directed at the Provider, the Provider's personal safety is violated, endangerment or abuse, or non payment, the Provider (or a responsible party) will immediately give Notice to Client. The Provider will receive payment for all services previously rendered. The Provider shall excuse Client of further payment obligations in this Agreement. The Provider will not be obligated to refund any portion of monies Client has previously paid to Provider. Any retainer collected will not be refunded. ​The Provider will receive paid transportation to the Provider's original home location if on a travel opportunity with the Client.
